شروط الاستخدام وحقوق النشر

1. الملكية وحقوق النشر

جميع محتويات موقع shoofaflam.tv — النصوص، الأوصاف، التحليلات التحريرية، الأسئلة الشائعة، التقييمات، البيانات المنظّمة، الصور المعدّلة، وقواعد البيانات المجمّعة — هي ملك حصري لـ «شوف أفلام» ومحمية بموجب قوانين حقوق النشر الدولية. لا يجوز نسخ أي جزء من هذه المحتويات أو تخزينه أو إعادة نشره دون إذن خطّي مسبق، باستثناء حالات الاستخدام العادل التي يسمح بها القانون.

2. شرط الإسناد الإلزامي

في أي حالة يُسمح فيها بإعادة استخدام أي جزء من محتوى الموقع — سواء للاقتباس، أو التحليل، أو إعادة النشر، أو الاستخدام في تطبيق طرف ثالث — يجب أن يكون مصحوباً برابط نشط وبارز إلى الصفحة المصدر على shoofaflam.tv وذكر اسم المصدر «شوف أفلام». أي إعادة استخدام بدون إسناد واضح ورابط مباشر يُعدّ خرقاً لشروط الترخيص الضمني للموقع.

3. حظر التدريب على البيانات والذكاء الاصطناعي

يُحظر صراحةً استخدام أي محتوى من هذا الموقع — كلياً أو جزئياً — في:

  • تدريب نماذج الذكاء الاصطناعي التوليدي (LLMs، نماذج الصور، نماذج التضمين)؛
  • تنقيب النصوص والبيانات (Text and Data Mining) لأغراض تجارية أو غير تجارية؛
  • إنشاء قواعد بيانات أو خدمات مشتقّة دون ترخيص خطّي؛
  • الاسترجاع بواسطة وكلاء آليين (scraping) لإعادة الاستخدام دون إسناد.

يُمارَس هذا الحظر كآلية انسحاب صريح وقابل للقراءة آلياً (machine-readable opt-out) وفقاً للأحكام القانونية المذكورة في القسم 5 أدناه.

4. الترخيص للوكلاء المرجعيين

يُسمح بشكل محدود لوكلاء البحث والاسترجاع — مثل ChatGPT-User، PerplexityBot، OAI-SearchBot، ClaudeWeb، Googlebot، Bingbot — بالوصول إلى المحتوى فقط بشرط أن تُضمَّن نتيجة كل استعلام رابطاً مباشراً ومرئياً إلى الصفحة المصدر على shoofaflam.tv. استخدام المحتوى دون هذا الرابط يُلغي هذا الترخيص فوراً.

5. الأساس القانوني للانسحاب

5.1 — EU DSM Directive 2019/790, Article 4 (TDM opt-out)

In accordance with Article 4(3) of Directive (EU) 2019/790 of the European Parliament and of the Council of 17 April 2019 on copyright and related rights in the Digital Single Market (“CDSM Directive”), the rightholder of the contents published on shoofaflam.tv hereby expressly reserves its rights to authorise text and data mining (TDM) of these contents for any purpose, including for the development and training of artificial intelligence systems and machine learning models. This reservation constitutes a machine-readable opt-out within the meaning of Article 4(3) CDSM Directive, signalled through:

  • this Terms of Use page (legal notice in natural language);
  • a noai, noimageai robots meta tag on every page of the website;
  • explicit Disallow directives for known AI training crawlers in the robots.txt file (including but not limited to GPTBot, Google-Extended, ClaudeBot, Anthropic-AI, CCBot, Bytespider, Amazonbot, Applebot-Extended, FacebookBot, PetalBot, omgili, Diffbot, ImagesiftBot, OmgiliBot);
  • a TDMRep policy file at /.well-known/tdm-policy.json declaring tdm-reservation: 1.

Any reproduction, extraction, ingestion, or use of these contents for TDM or AI training without a separate written licence constitutes copyright infringement under the laws of the Member States transposing the CDSM Directive.

5.2 — EU AI Act, Article 53(1)(c)

Pursuant to Article 53(1)(c) of Regulation (EU) 2024/1689 of the European Parliament and of the Council laying down harmonised rules on Artificial Intelligence (“AI Act”), providers of general-purpose AI models placed on the European Union market are required to put in place a policy to comply with Union law on copyright and related rights, and in particular to identify and comply with reservations of rights expressed pursuant to Article 4(3) CDSM Directive.

Accordingly, any general-purpose AI provider that ingests contents from shoofaflam.tv — directly or via a downstream dataset, scraper, or third-party intermediary — is on notice that the present reservation of rights applies and must be respected under Article 53(1)(c) AI Act. The rightholder reserves the right to request disclosure of training data sources under Article 53(1)(d) AI Act and to pursue remedies under applicable copyright law in case of non-compliance.

6. الإنفاذ والعلاجات القانونية

يحتفظ «شوف أفلام» بكامل الحق في اتخاذ أي إجراء قانوني متاح، بما في ذلك على سبيل المثال لا الحصر:

  • طلبات إزالة DMCA (انظر سياسة DMCA)؛
  • إخطارات بموجب المادة 17 من توجيه EU DSM لمزوّدي مشاركة المحتوى عبر الإنترنت؛
  • مطالبات تعويضات عن استخدام تجاري للمحتوى دون ترخيص؛
  • طلبات الإفصاح عن مصادر التدريب من مزوّدي GPAI بموجب المادة 53(1)(د) من قانون AI الأوروبي.

7. الاتصال للترخيص

للحصول على ترخيص خطّي صريح لاستخدام أي جزء من المحتوى — سواء للتدريب، أو إعادة التوزيع التجاري، أو الاندماج في خدمة طرف ثالث — يرجى التواصل عبر:

8. التعديلات والقانون الواجب التطبيق

تخضع هذه الشروط للتحديث الدوري. التاريخ المثبت أعلاه يُعتبر تاريخ النفاذ الحالي. النزاعات تخضع للقانون المعمول به في موقع المُرخِّص، مع الاحتفاظ بحق المُرخِّص في رفع الدعاوى في أي ولاية قضائية يحدث فيها الانتهاك.
